§ 1 Scope of Application
(1) These General Terms and Conditions apply to all business relations between Kur und Bäder GmbH Bad Krozingen (hereinafter "Organizer" or "KBG") and their customers in the respective current version at the time of contract conclusion.
(2) Our General Terms and Conditions apply exclusively. Conflicting or deviating terms of the customer are not recognized, unless Kur und Bäder GmbH Bad Krozingen has expressly agreed to them in writing in individual cases.
§ 2 Conclusion of the Contract
(1) The sale of goods and services is only carried out in household quantities. The presentation of the product range of Kur und Bäder GmbH Bad Krozingen does not constitute an offer within the meaning of §§ 145 et seq. BGB (German Civil Code).
(2) By sending an order in writing, verbally, online via a form on the website, or by e-mail to Kur und Bäder GmbH Bad Krozingen, the customer submits an offer within the meaning of § 145 BGB. For online orders via a form, the customer receives a confirmation of receipt of the order. Kur und Bäder GmbH Bad Krozingen will point out possible errors in the product details on the website to the customer separately if necessary and submit a corresponding counter-offer.
(3) The contract with Kur und Bäder GmbH Bad Krozingen is concluded when Kur und Bäder GmbH Bad Krozingen accepts this offer. Acceptance is subject to the availability of the ordered goods or services. For online orders, a contract confirmation is sent to the customer by e-mail. If Kur und Bäder GmbH Bad Krozingen cannot accept the customer's offer, this will be communicated to the customer.
(4) For larger orders, Kur und Bäder GmbH Bad Krozingen reserves the right to request a corresponding deposit. The order will be processed after receipt of the deposit.
§ 3 Delivery
(1) Kur und Bäder GmbH Bad Krozingen will immediately deliver the ordered goods to the address specified by the customer in the order. Kur und Bäder GmbH Bad Krozingen is entitled to make partial deliveries.
(2) Delivery is made at the shipping costs indicated in the individual case.
(3) Information about the estimated delivery period is non-binding, unless Kur und Bäder GmbH Bad Krozingen has given the customer a binding promise in writing in individual cases.
§ 4 Multiple-Entry Cards, Vouchers, E-Tickets
(1) Multiple-Entry Cards:
- They are subject to the statutory limitation period of three years. This period begins with the end of the calendar year (December 31) in which the multiple-entry card was purchased (§ 195, § 199 BGB). After this period, they lose their validity and can no longer be redeemed.
- They are price-bound for a period of 12 months from the purchase date. In the event of redemption after these 12 months, the difference resulting from any price increase for the corresponding service in the meantime must be paid.
(2) Vouchers (both commodity and monetary value vouchers):
- They are subject to the statutory limitation period of three years. This period begins with the end of the calendar year (December 31) in which the voucher was purchased (§ 195, § 199 BGB). After this period, they lose their validity and can no longer be redeemed.
- Commodity/service vouchers are additionally price-bound for a consumer-protective period of 12 months from the purchase date. In the event of redemption after the 12-month price binding (but before the statute of limitations takes effect), the difference must be paid in the event of a price increase for the service in the meantime.
(3) Cash payout of vouchers is excluded.
(4) The offered E-tickets represent time-bound entry or usage rights for leisure and wellness services and apply exclusively to the date stated on the ticket and, if specified, to the respective time window. According to § 312g para. 2 no. 9 BGB, there is no right of withdrawal for dated E-tickets, as these are contracts for the provision of leisure services with a specific date or period. Cancellation, rebooking, or refund of dated E-tickets is therefore excluded. If not used (not redeemed) by the customer, the ticket expires without replacement after the expiration date; statutory claims of the customer in the event of a service failure attributable to Kur und Bäder GmbH Bad Krozingen remain unaffected.
§ 5 Cancellation of Wellness Applications and Physiotherapy Appointments
(1) Firmly booked appointments for wellness applications and massages in the Wohlfühlhaus can be cancelled or rebooked free of charge up to 24 hours before the agreed appointment.
(2) In the event of cancellation or rebooking less than 24 hours before the agreed appointment or in the event of non-appearance, 100% of the agreed remuneration becomes due or an amount already paid is not refunded. The customer is permitted to prove that Kur und Bäder GmbH Bad Krozingen suffered no damage or a significantly lower damage, or saved expenses to a significant extent.
(3) For physiotherapy services, the conditions of the treatment or patient contract to be concluded at the beginning of the treatment apply exclusively.
(4) Medical tub baths and applications in undiluted thermal water are highly strainful for the cardiovascular system. The execution takes place at the customer's own health risk. Persons with cardiovascular diseases, venous disorders, or acute infections are urgently recommended to seek medical advice before booking or execution.
(5) If a customer remains in the therapy pool on his own initiative after the end of a prescribed or booked individual therapy (e.g. physical therapy individual treatment in water), the therapist's or instructor's duty of clinical supervision expires with the official end of the agreed therapy unit. Further use of the pool occurs at the customer's own risk and responsibility within the framework of general pool operations.
§ 6 Tickets, Season Tickets and Transponder Use
(1) Single entry tickets and prescriptions: Single entry tickets and entry tickets via prescription are only valid on the day of purchase or day of bathing. In the case of prescriptions, the separate conditions of the health insurance companies also apply.
(2) Season tickets (annual, half-year, and seasonal cards):
- These cards are personalized, non-transferable, and can only be used once a day.
- Season tickets are generally non-extendable and non-refundable.
- Exceptions for severe illness may be examined in individual cases upon presentation of a medical certificate. Illnesses of less than 3 weeks' duration do not lead to an extension.
(3) Discounts: Discounts of the Bad Krozingen customer card, the BZCard, or other partner discount systems cannot be combined (only one discount system can be used per purchase transaction).
(4) Transponder use and loss: A credit balance is stored on the admission tickets (single, multiple, season, and value cards) as well as chip wristbands to enable cashless payment in the pool. In the event of negligent loss of the transponder or wristband, the corresponding damage (replacement value for the card as well as the balance demonstrably booked on it) must be paid.
(5) Abuse: Any abuse of admission tickets, season tickets, or transponders leads to immediate withdrawal of the access authorization and a house ban. The operator reserves the right to take legal action.
(6) Refund and reduction: A refund or reduction of the admission price is excluded, unless statutory claims stand in the way. In particular, the temporary closure or restriction of individual pools, sauna cabins, or parts of the facility (e.g., for operational reasons such as cleaning, maintenance, technical defects, course usage, or events) does not entitle the customer to a reduction or refund of the admission price, provided the overall facility remains essentially usable.
§ 7 Sport Courses and Course Offers
(1) Course offers (e.g., Aqua-Fitness, prevention courses, sports and gymnastics courses) of Kur und Bäder GmbH Bad Krozingen are personalized and generally non-transferable.
(2) Absences are generally at the participant's expense. There is no claim to a refund. Upon presentation of a medical certificate, the management may, in individual cases and as a gesture of goodwill, issue at most a value voucher. There is no legal entitlement to receive a voucher or a refund. The certificate must be presented to the organizer immediately, but at the latest by the end of the course period. A cash payout is excluded.
(3) Catching up on missed sessions in the same course module is in principle possible without prior agreement, provided free capacities are available. However, firmly booked participants of the respective appointment always have priority. Missed training dates and course entries expire without replacement at the end of the respective course.
(4) If a course hour or an entire course has to be cancelled by KBG (e.g., due to illness of the instructor or technical defects), a make-up date will be offered. If this is not possible, the fee for the cancelled appointment will be refunded or credited proportionally.
(5) Courses only take place when a specified minimum number of participants is reached. If this is not reached, KBG reserves the right to cancel the course up to 3 days before it begins. Fees already paid will be fully refunded in this case.
(6) A cancellation or withdrawal by the participant before the start of the course is possible free of charge up to 7 days before the first course date. In the event of a later cancellation of less than 7 days before the start of the course, a cancellation fee of 50% of the course fee becomes due, unless the participant provides a suitable substitute participant. After the start of the course, cancellation is excluded. A rebooking to another course is possible before the start of the course (subject to availability) against a handling fee of 10.00 €. After the start of the course, rebooking is excluded.
(7) The instructions of the course instructor and the supervising staff must be strictly followed. Participants who permanently disrupt the course, endanger themselves or others, or disregard instructions can be excluded from the course. In this case, there is no claim to a refund of the course fee.
(8) The course equipment and training utensils provided (in particular Aqua-Cycling bikes and weights) must be treated with care. Damage caused by improper handling or gross negligence is at the expense of the participant. Adjusting the Aqua-Cycling bikes as well as putting them into the pool and lifting them out of the pool may only be carried out under the exact instruction and supervision of the course instructor. A pre-reservation of certain places in the pool or individual training devices (e.g., specific Aqua-Cycling bikes) by participants before the start of the course is not permitted; the choice of place and device takes place before the start of the course according to the "first come, first served" principle (availability upon arrival).
(9) For courses in the Yoga Studio (Thürachstraße 6), the following additional regulations apply: The studio is opened at the respective course date; participants are asked to gather at the entrance door on the 2nd floor approx. 5 minutes before the start of the course. As there are no changing rooms on site, it is necessary to appear directly in training/yoga clothing. A towel and, if desired, a separate yoga mat must be brought by the participants themselves.
(10) For Aqua courses in the aquarado leisure pool, the following additional regulations apply: Participants are asked to gather at the swimmer pool approx. 5 minutes before the start of the course. The admission tickets or access media for the course period are issued at the ticket cash desk on the first day of the course, are personalized, and are non-transferable. They apply exclusively to the duration of the course (including any approved make-up dates); unused course dates or admissions expire without replacement at the end of the respective course.
(11) For children's swimming courses (from 6 years) in the aquarado leisure pool, the following additional regulations apply: Meeting point is approx. 5 minutes before the start of the course in the entrance area (foyer) of the aquarado. Accompanying the children into the pool area or changing rooms by parents or accompanying persons is not permitted during the course. The duty of supervision of the course instructor only begins with the handover of the children at the meeting point at the start of the course and ends with the return of the children at the same meeting point immediately after the end of the course. Before the handover and after the return, the duty of supervision remains fully with the parents or accompanying persons.
(12) For swimming courses in the Vita Classica Spa (swimming pool in the Musikhalle), the following additional regulations apply: Meeting point is approx. 5 minutes before the start of the course in the entrance area of the Wohlfühlhaus (extension of the corridor in the Vita Classica building or separate entrance to the Musikhalle). Access to the Vita Classica Spa is only permitted for the duration of the respective course unit. Accompanying the children into the pool area or changing rooms by parents or accompanying persons is not permitted during the course. The duty of supervision of the course instructor only begins with the handover of the children at the meeting point at the start of the course and ends with the return of the children at the same meeting point immediately after the end of the course. Before the handover and after the return, the duty of supervision remains fully with the parents or accompanying persons.
(13) For courses on water habituation for toddlers and baby swimming in the Vita Classica Spa, the following additional regulations apply: The regular course fee includes the participation of exactly one adult accompanying person. The participation of a second accompanying person is permitted exclusively for baby swimming, only after prior registration and against payment of a separate fee. Proof of payment for the second accompanying person must be presented for the first course hour. The last date of the course is intended as a make-up date for missed units; there is no further claim to make-up or refund of absences.
(14) Course participants via Hansefit who apply a coupon do not receive a multiple-entry wristband for Aqua courses. These participants must obtain a corresponding day ticket via Hansefit for each course date.
§ 8 Retention of Title
Until complete payment of all claims existing against the customer, the delivered goods remain the property of Kur und Bäder GmbH Bad Krozingen.
§ 9 Prices, Maturity and Payment
(1) All prices quoted are final prices in Euro (EUR) and include the statutory value added tax. In addition, there are the respective shipping costs, which are shown separately before the order is completed.
(2) Kur und Bäder GmbH Bad Krozingen only accepts the payment methods displayed to the customer as part of the ordering process.
(3) The purchase price becomes due upon conclusion of the contract.
(4) If the customer is in default, Kur und Bäder GmbH Bad Krozingen is entitled to demand default interest of 5 percentage points above the respective base interest rate. The right of Kur und Bäder GmbH Bad Krozingen to claim higher damage remains unaffected, as does the right of the customer to prove lower damage.
(5) The customer is only entitled to offset if his counter-claim is undisputed, legally established, or ready for decision, or if it is based on the same contractual relationship.
§ 10 Right of Withdrawal for Consumers
(1) The consumer has the right to withdraw from this contract within 30 days without giving reasons by informing Kur und Bäder GmbH Bad Krozingen of his decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, an e-mail, or via the button available in the online shop). Simply returning the goods without a statement is not sufficient to meet the deadline.
(2) The customer bears the direct costs of returning the goods.
(3) In the event of withdrawal, Kur und Bäder GmbH Bad Krozingen will refund the purchase price paid immediately and at the latest within 14 days from the day on which the notification of withdrawal of the contract was received by us.
(4) In the event of significant deterioration or loss of the goods, the customer must pay compensation in the event of his withdrawal if the loss in value is due to handling of the goods which was not necessary to inspect the condition, properties, and functionality of the goods.
§ 11 Warranty
(1) Kur und Bäder GmbH Bad Krozingen is liable for defects in accordance with statutory provisions. The warranty period for consumers is two years for newly manufactured goods. For used items, the warranty period is one year, provided this was agreed before the consumer's contract declaration and was expressly and separately agreed in the contract.
(2) If there is a defect, the customer can choose to have it remedied by removing the defect or by delivery of a replacement.
(3) If the defect removal or replacement delivery fails, if Kur und Bäder GmbH Bad Krozingen is not willing or able to do so, or if it is delayed beyond reasonable periods for reasons for which Kur und Bäder GmbH Bad Krozingen is responsible, the customer is entitled to cancel the contract (withdrawal) or demand a reduction of the purchase price.
§ 12 Data Protection
Our data protection practice is based on the statutory provisions, in particular the EU General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG). § 13 Liability
(1) Kur und Bäder GmbH Bad Krozingen is liable without limitation for damages resulting from injury to life, body, or health based on an intentional or negligent breach of duty, as well as for other damages based on an intentional or grossly negligent breach of duty or malice.
(2) In the event of a slightly negligent breach of material contractual obligations (cardinal obligations), Kur und Bäder GmbH Bad Krozingen is only liable for the contractually typical, foreseeable damage. Cardinal obligations are obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the customer may regularly rely.
(3) In all other respects, the liability of Kur und Bäder GmbH Bad Krozingen is excluded. Insofar as liability is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents.
§ 14 Final Provisions, Place of Jurisdiction, Dispute Resolution
(1) This contract is subject to the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. In the case of consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence.
(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relations between the customer and Kur und Bäder GmbH Bad Krozingen is the registered office of the operator (Bad Krozingen / competent court is the District Court of Freiburg or Regional Court of Freiburg).
(3) Kur und Bäder GmbH Bad Krozingen is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
